Introduction

This Privacy Notice sets out the commitment of Numerator UK Limited (trading as Worldpanel by Numerator), Vivo Building, 30 Stamford St, London SE1 9LQ and its affiliates Kantar Group companies (altogether "Kantar", "we", "our" or "us"), a Kantar Group company ("Kantar"), to the privacy of its panel members ("panellists", "panellist" or "you"), and governs panellists’ rights regarding privacy and data protection.

This Privacy Notice applies to the Shop & Scan Panel identified in this Privacy Notice as the "panel". For clarity, this Notice is publicly available on the Shop & Scan website.

Panellists are members of the panel, operated by Kantar and for which Kantar is the ‘data controller’, responsible business (or similar term) for the purposes of applicable data protection law. This means that Kantar is the overarching responsible party for your personal data for the panel, as it determines the purposes and means of the processing of your personal data. For the purposes of this Privacy Notice, ‘personal data’ means any data or information that relates to an identified or identifiable living individual.

Where you provide information relating to other members of your household, they must give their consent to the use of their personal data in the ways described in this Notice. We strongly recommend that members of your household review this Notice before their personal data is provided to us.

Taking part in our panel, surveys and research activities is entirely voluntary. By registering to the panel and accepting the relevant terms, you confirm that you have read and understood the terms of this Privacy Notice. We ask you to read this Privacy Notice carefully.

Lawful Collection and Use of Data

Except where you have registered directly with us, we have contacted you to take part in the panel by telephone, post, face to face or online by:

  • Receiving your contact information from a third party, such as a research panel or sample provider that you have registered with or been in contact with
  • Receiving your contact details from the client we are conducting the survey for, with whom you may either be registered, employed, received products or services from or generally dealt with – in most cases for online surveys, we do not receive your contact information and the third party simply invites you to join our survey
  • Or you have previously agreed to be re-contacted by us to possibly participate in further panels or surveys

We collect your personal data in several ways such as through our Shop & Scan mobile application, our barcode scanners, our website(s) and surveys. This will include information contained in receipts that you submit by photographing the physical receipt, contact details and demographic information that you provide at time of registration and through surveys during your panel membership. We may ask you to send optional video, audio or image content to us through a survey. We may add other ways and activities moving forward but we will always operate in compliance with this Notice.

We have set out more detailed information below about how we use your personal data. Some data protection laws require that we have a ‘lawful basis’ for our processing, which is a legal justification that has been pre-defined by the relevant law for collecting, storing and using personal data. For your information where that requirement exists, we have set out below the relevant lawful basis alongside the applicable purpose. The legal bases we commonly use are listed below and could be different for each use case:

  • we have your consent for the use of your personal data;
  • we need to use your personal data in order to perform a contract with you; or
  • the use of your personal data is necessary for our (or our clients’) legitimate interests (in which case we will explain what those interests are).

If you receive an email that concerns you, purporting to be from us, please let us know as shown below in the "How to Contact Us" section of this Notice.

Third Parties (Clients and Suppliers)

We may share your personal data (including your sensitive personal data) with companies in the Kantar Group and our third-party vendors and processors to perform panel management and data processing related activities in order to deliver panel services and activities to you. This could include vendors managing or assisting us in managing our panel databases, marketing automation and CRM, quality checks and fraud prevention, incentive management, and customer care. Categories of personal data shared with these vendors would typically be, but may not be limited to, name, email address, postal address, phone number, cookie ID, panellist ID, IP address and the information you submit in our market research surveys or barcode and receipt capture activities.

Kantar Group companies and our third-party data partners and publishers are all contractually bound to keep any information they collect and disclose to us, or that we collect and disclose to them, confidential and must protect it with security standards and practices that are equivalent to our own.

Kantar uses the following third-party vendors for the processing of your personal information:

Selling of your Personal Data

Under some data protection laws (for example, the California Consumer Privacy Act), ‘sales’ of personal data are broadly defined. As part of the services that we provide to you as a research respondent, you have agreed to participate in market research which may necessarily involve sharing your personal data with our relevant client that purchases the research. For example, we will share your survey responses or products purchased with a relevant client where we have collected them directly or other relevant information we hold about you. We do not consider this as a ‘sale’ of your personal data, as you have joined the research to intentionally disclose your personal data as part of the service (i.e., for incentives). No personal or contact information is shared with a client other than your product purchase history and you would not be identifiable as part of this data sharing. In any event, your participation in a survey is always voluntary and we seek your consent.

Otherwise, we do not sell your personal data and have not done so in the last 12 months, and we do not sell or share sensitive personal data, nor do we sell or share any children’s personal data.

Data Transfers

Your personal data may be collected, stored, transferred or processed by companies within the Kantar Group, or third-party service providers for research-related purposes, such as data processing and enrichment, both within and outside your territory. Unless the survey or study requires it, your identity will not in practice be discoverable by the third parties. All parties are contractually bound to keep any information they collect and disclose to us, or we collect and disclose to them, confidential and must protect it with appropriate security standards and practices. If your personal data is transferred to, stored at or otherwise processed outside your country or territory, and that country or territory has not been recognized as providing an adequate level of data protection, we will put in place additional safeguards to protect your personal data, as required by applicable law. For example, if you are in the EEA, standard contractual clauses issued by the European Commission and further appropriate protective measures would be used if we process your data outside the EEA. Where required by law, we will also request your consent for these transfers in accordance with this Notice and any other necessary information that we provide to you separately.

Confidentiality, Security and Industry Requirements

We take appropriate technological and organisational measures to protect your personal data, both during transmission and once we receive it. Our security procedures are consistent with generally accepted standards used to protect personal data.

Measures include security and storage controls that integrate our data and network security policies and procedures with the security requirements of our clients and in line with the requirements of local data protection laws. All Kantar personnel laptops are encrypted, include network protection and storage/processing on removable media/devices is prohibited. Removable media and mobile devices are stored in locked cabinets/drawers/rooms with restricted access together with secure building access. Kantar has also invested in endpoint protection (including anti-malware), threat intelligence, and response services. These measures are deployed across all workstations and servers covering the Kantar estate. Industry/government standard encryption in place - AES128 (Mac) or AES256 (PC), used as standard across the business.

Where you have been asked to create an account with us, your account information and personal data are password protected so that you and only you have access to your information. In order to keep your personal data safe, we recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Please change your password regularly.

In the case of an unfortunate personal data security incident, we will, in a timely manner and in accordance with laws and regulations, inform you of the basic conditions and possible impacts of the security incident, response measures that are already taken or to be taken by us, suggestions for you regarding self-prevention and risk mitigation, our remedial measures for you, etc. We will inform you of such information by email or push notification, etc., and when it is difficult to notify each individual panellist individually, we will properly and effectively issue a public notice. At the same time, we will also take the initiative to report the handling of personal data security incidents in accordance with regulatory requirements.

We adhere to various standards and industry codes depending on your location, including:

  • European Society for Opinion and Market Research (ESOMAR)
  • European Pharmaceutical Market Research Association (EphMRA)
  • Market Research Society (MRS UK)
  • British Healthcare British Intelligence Association (BHBIA)
Cookie Disclosure

Cookies are small text files stored on your computer or mobile device by a website that assigns a numerical user ID and stores certain information about your online browsing. Cross-context behavioural advertising refers to targeted advertising based on personal information collected from you when you interact with our website or other digital platforms. Except as otherwise described in this Notice, we do not provide your personal data to third parties for cross-context behavioural advertising purposes.

Accuracy

We take reasonable steps to keep personal data in our possession or control accurate, complete and current, based on the most recent information made available to us by you and/or by our client. We rely on you to help us keep your personal data accurate, complete and current by answering our questions honestly. You are responsible for ensuring that you notify us of any changes to your personal data. To update your personal data, please contact us, using the contact details available via the Shop & Scan app or website.

Children’s Data

We recognise the need to provide further privacy protections with respect to personal data collected from children. We never knowingly invite children under the legal age set by the authorities in the country in which you reside to participate in research studies without appropriate permission. If it is necessary and appropriate to a particular project to directly involve children, we take measures to ensure we have obtained permission from a parent and/or legal guardian. We will provide parents and/or a legal guardian information about the survey topic, any personal or sensitive information which may be collected from the children, the way the data will be used and whether and with whom we may share such information.

You must be at least 16 years of age to participate in Shop & Scan and we don’t knowingly invite children to participate in the panel task. Limited information about any children in your household, including name and age, is collected voluntarily in the Shop & Scan registration survey. This is to help us understand the demographic composition of your household. This data is processed with all of the protections outlined in this Notice.

Sensitive Personal Data

From time to time, we may collect personal data that is classified as "sensitive" or "special category" personal data. The meaning of this type of personal data varies under data protection laws of different countries. Taking this into account, we treat sensitive personal data as personal data that, if misused or leaked, could potentially endanger an individual’s safety, damage their reputation or health, or lead to discriminatory treatment. This includes racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

During your time on the panel and in your participation of surveys, you may be asked if you want to provide sensitive personal data. You can always choose whether to provide this data to us. We have included the types of sensitive personal data we ask to collect from you in the above "Lawful Collection and Use of Data" section of this Notice, including the relevant purpose for processing.

Rights of Individuals

Depending on your location and the data protection laws that apply to Kantar’s processing of your personal data, you may have one or more of the following rights in relation to your personal data:

You can choose to deactivate or delete your Shop & Scan account at any time as per the rights listed above. This can be done by contacting us, using the contact details available via the Shop & Scan app or website.

Your rights may be limited — for example, if fulfilling your request would reveal personal data about another person, where it would infringe the rights of a third party (including our rights) or if you ask us to delete data which we are required by law to keep or have compelling legitimate interests in keeping. We will inform you of relevant exemptions we rely upon when responding to any request you make.

If necessary, we shall also notify third parties to whom we have transferred your personal data of any changes that we make on your request. Note that while we communicate to these third parties, we are not responsible for the actions taken by these third parties to answer your request. You may be able to access your personal data held by these third parties and correct, amend or delete it where it is inaccurate.

Accessing Personal Data Rights

To request access to personal data that we hold about you, please see the contact details in the "How to Contact Us" section. When you make a request, you should provide your panellist ID or any other relevant identifiers. If you contact us using an email address or contact details for which we do not hold a record of, we may also request you provide a copy of a valid government issued or official identification (such as drivers licence or passport) to verify your request. We do not discriminate against you for exercising any of the rights listed above or any other rights you may have.

You may be entitled to use a third party to submit a request to us on your behalf (sometimes referred to as an ‘authorised agent’ or similar). For this purpose, we will require proof that you gave that third party signed permission to submit the request, which may be in the form of a power of attorney. We may also require additional verification, such as the identity of the third-party individual.

We aim to respond to your requests to access your personal data rights as soon as possible. However, we will respond within the timeframes determined by the applicable data protection law. In some countries, that is one calendar month or 30 days from receipt of the request. Timeframes under data protection laws may be paused whilst we collect essential information from you, such as verification of your identity.

We will not charge you for your reasonable requests in principle. However, where permissible under application laws, a fee to reflect the cost will be imposed as appropriate on repeated requests beyond reasonable scope. As for repeated requests that are groundless and need excessive technological means (e.g. developing a new system or fundamentally changing the current practices) to fulfil, involve risks to others’ legitimate rights and interests or are impractical (e.g. involving information stored on a backup disk), we may reject your request, subject to applicable data protection laws.

Some data protection laws also prevent us from granting your access to your personal data rights, such as where this affects national, defence or public security; major public interests; criminal investigations, prosecutions, trials or enforcement of judicial decisions; the life, property or other important legal rights and interests, or those of other individuals; and trade secrets.

Data Storage and Retention

Personal data shall be retained only for such period as is appropriate for its intended and lawful use. We shall retain your personal data for as long as you are a member of the panel, including any personal data within the images of paper or emailed receipts.

Shop & Scan studies observe long-term consumer behaviour requiring a ten-year history of panel members purchasing and demographics. In the event that you no longer participate in Shop & Scan, we shall retain your purchasing and demographic data in a secure environment, for a minimum period of 10 years after you cease participation, unless otherwise required by law. Data that is unnecessary for our research, in particular contact details and all personally identifiable data (for example names, phone numbers and emails), will be deleted five years from the date you leave the panel. This data is stored for this pre-defined length of time to ensure we do not re-invite panellists for a reasonable length of time after leaving the panel and this data will not be passed on to any third parties. Personal data that is no longer required shall be disposed of in a manner that ensures that the confidential nature is not compromised.

As part of the Company Business Continuity Plan and as required by ISO 27001, ISO 9001, ISO 20252 and in certain instances the law, our electronic systems are backed up and archived. These archives are retained for a defined period of time in a strictly controlled environment. Once expired, the data is deleted and destroyed to ensure the data is erased completely.

Automated Decision-making

We may use automated decision-making during the analysis of data submitted by our Shop & Scan panellists.

The volume and frequency of submitted shopping trips are analysed for accuracy, patterns of realistic purchasing behaviour and fraud prevention. Shop & Scan accounts flagged by the automated processes will be subject to secondary review and human decision. Because the data collected is used for market research purposes to build an accurate picture of shopping behaviour, flagged accounts could be subject to closure at the sole discretion of Kantar.

Automated decision-making is also used to review the demographic profile of Shop & Scan panellists. In the event of significant over-representation in certain demographic groupings, and to ensure a balanced panel representing the population, Kantar may close Shop & Scan accounts to achieve this balance. Notice will be given to panellists affected by this automated decision-making process.

In such instances, you are also entitled to other related rights (see the "Rights of Individuals" section of this Notice).

Updates to our Privacy Notice

We keep our Privacy Notice under regular review and it may be amended from time to time and at least every 12 months. We will always have the most up-to-date Notice on our website, or within your panel portal. We will record when the Notice was last revised. Non-material changes to this Privacy Notice will be announced through the panels’ sites only.

Shop & Scan Membership Terms & Conditions

These Shop & Scan Membership Terms & Conditions ("Terms", "Agreement") describe the terms and conditions applicable to the Shop & Scan Panel operated and owned by Numerator UK Limited (trading as Worldpanel by Numerator), Vivo Building, 30 Stamford St, London SE1 9LQ ("Worldpanel by Numerator", "We"), a Kantar group company ("Kantar"). This Agreement sets the commitments of Worldpanel by Numerator and the Shop & Scan Panellists in regards to their participation in the Panel (as each capitalized term is defined herein). You should read these Terms, understand them, and review them periodically for updates. Your participation as a Shop & Scan Panellist means you understand and agree to be bound by this Agreement. If you do not agree to these Terms, do not use our Site or Services.

For clarity, these Terms apply to your access to, and use of, Worldpanel by Numerator's sites, social and mobile applications (altogether the "Site") and the services provided by Worldpanel by Numerator, including the Shop & Scan Panel and related research services.

  1. The Services

    The Services allow living individuals who meet certain eligibility requirements to register as a member ("Panellist") of our research panel (the "Panel") and to participate in the various online and offline research activities ("Activities") made available to them and proposed by Worldpanel by Numerator (altogether the "Services"). These Activities, always market research-related, are delivered by Worldpanel by Numerator directly, or through or with the support of, third-parties working for Worldpanel by Numerator ("Vendors") or our clients ("Clients"). Virtual agents, robots or other forms of programs that simulate human activity are not permitted to register as Panellists.

  2. Service Eligibility and Registration

    The Services may be used only by individuals who are at least 16 years of age and are not intended for the use of children under 16 years of age. These Terms, and any associated use of the Services is void where prohibited.

    After your registration to the Panel, a Panel account ("Account") will be created. You are solely responsible for this Account, which you need to protect at any times with a password that you must keep securely.

    Individuals are only able to register one Account. Only residents of Great Britain (excluding Northern Ireland, Channel Islands and Isle of Man) can register to join the Panel. You should not try to access our Services from another country as your Account may be suspended.

    BY ACCESSING OR USING THE SERVICES, YOU REPRESENT AND WARRANT THAT YOU MEET THESE ELIGIBILITY REQUIREMENTS AND WILL ABIDE BY THE TERMS OF THIS AGREEMENT.

  3. Fees for the Services

    There is currently no fee for Panellists to participate in the Services. Worldpanel by Numerator may, in its sole discretion, elect to charge fees for participating in the Services, or to use or access any other services, at any time. If it does, Worldpanel by Numerator will update these Terms to reflect any such changes and will notify you 30 calendar days in advance.

  4. Rewards

    Once you have joined the Panel, Shop & Scan Points ("Points") or other Shop & Scan types of incentives will be awarded when you undertake various Activities on the Site, in line with the Rewards Program Terms.

    Points are credited to your Account and are available for you to redeem as long as your Account is "active" (see Section 7 of these terms). Points can only be redeemed for rewards after 30 days following Account registration.

    Points have no monetary value, and no value outside of our Services, and will not earn interest. You cannot sell, trade or transfer Points, or exchange them for cash.

    Each party shall be solely responsible for any tax(es) imposed upon it by applicable law(s), including any taxes on a party’s income, or relating to a party’s receipt of Points pursuant to these Terms.

  5. Participation requirements

    Your ability to participate in the Services is expressly conditioned upon your compliance with these Terms and with all policies and guidelines applicable to the Services that Worldpanel by Numerator may make available from time to time. In the event of your non-compliance, fraud or other inappropriate activity (as determined by Worldpanel by Numerator in its sole discretion), Worldpanel by Numerator may close or suspend your Account. The closure or the suspension of your Account may restrict, block, limit, and prevent your access to and use of the Services and, further, all Points, incentives and rewards shall be subject to forfeiture (see Section 7 of these terms).

    Without limiting the generality of the foregoing, non-compliance of one of the following requirements may automatically lead to the closure of your Accounts, forfeiture of any Points, and all related consequences to your participation in the Panel.

    5.1 Confidentiality

    Information and content made available to you as part of the Services may contain trade secrets or other confidential or proprietary information of Worldpanel by Numerator, its Vendors, Clients or licensors. You must hold in strict confidence and not disclose to any other person any information and content that you access or learn in connection with your participation in any Panel, survey, project, questionnaire, or other market research activity related to the Services. You must not use any such information or content for any purpose other than your participation in the Services in accordance with these Terms.

    You hereby agree to notify Worldpanel by Numerator immediately if you learn of or suspect any use or disclosure of, or access to, any such information or content other than as specifically authorized in these Terms.

    5.2 True and accurate panel profile information

    You agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Services and (b) maintain and promptly update your panel profile information and any other information you provide to Worldpanel by Numerator, so as to keep it accurate, current and complete. Registration requires information about You that includes, without limitation, full legal name, date of birth, individual demographic information, the address of your primary residence, phone number and functioning email address.

    5.3 Multiple Accounts

    Only one Account per living individual is allowed at any time.

    5.4 Compliance with laws

    You must at any times comply with all applicable laws, rules, regulations, and orders, and not cause Worldpanel by Numerator to violate any laws, rules, regulations, or orders.

    5.5 Good-faith participation

    You agree to participate in good faith and to the best of your ability in any Activities in which you participate in connection with the Services. You will not provide false or misleading data, including without limitation, survey responses that are false, inconsistent with prior responses, or statistically improbable.

    5.6 Appropriate communications

    If you communicate with our Helpdesk Team or other Worldpanel by Numerator or Shop & Scan personnel ("Personnel"), you agree to do so in a respectful and appropriate manner. You shall not send, upload, share or otherwise distribute to Personnel, Personnel of Vendors, or other users of the Services any rude or offensive communications or any content that is obscene, vulgar, sexually-oriented, shock-oriented, threatening, hateful, illegal or otherwise inappropriate.

    5.7 Quality checks

    As a member of our Panel, we need and expect you to participate in line with reasonable but strict quality standards. Periodic reviews will be conducted on the quality of information received. This includes:

    • At least weekly accurately reporting your purchase behaviour, including reporting on nothing bought if you did not buy anything in that week (Nothing Bought). Continued reporting of Nothing Bought will lead to Account review and possible closure – referenced in Section 7.
    • Accurately completing the required Panel profile information.
    • Accurately completing questionnaires We consider a key task of Panel membership.
    • If applicable, accurately completing optional questionnaires.
  6. User Content

    You may provide information to Worldpanel by Numerator in connection with your participation in the Activities or otherwise in connection with the Services, including survey responses, ideas, feedback, or other information or content ("User Content"). If you provide any User Content, unless Worldpanel by Numerator expressly indicates otherwise, you grant Worldpanel by Numerator, its Vendors and Clients a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content throughout the world in any media for any and all known purposes, without acknowledgement or compensation to you.

    By providing any User Content, you represent and warrant that you have the lawful right to provide it, and that it is accurate and complete. You must not provide any User Content that:

    • Is unlawful, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, false, inaccurate, misleading, fraudulent, or impersonates or misrepresents an affiliation with any person or entity;
    • Would violate an obligation of confidentiality or the rights of any person or entity, or that would otherwise create liability or violate any local, national, or international law;
    • May infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any person or entity;
    • Contains any private information of any person or entity, including, without limitation, addresses, phone numbers, email addresses, National Insurance numbers, and credit card numbers;
    • Contains any viruses, corrupted data or other harmful, disruptive, or destructive files or information; or
    • In the sole judgment of Worldpanel by Numerator, is objectionable, does not reflect your good faith efforts to be responsive to survey or market research questions, or which may expose Worldpanel by Numerator or its Vendors or Clients to liability of any type.

    You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, original or creative materials, or other information or content provided by you to Worldpanel by Numerator, to the extent it is not User Content, will become the sole property of Worldpanel by Numerator. Worldpanel by Numerator will own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of such information and content for any purpose, commercial or otherwise, without acknowledgment or compensation to you. Further, you hereby grant to Worldpanel by Numerator a perpetual and irrevocable license to use such information and content for any purpose.

  7. Keeping your Account in good standing

    When you register to the Panel, Worldpanel by Numerator will open an Account for you. Full registration requires access to the Site, including website and app where you will choose passwords. You are, at all times, responsible for maintaining the security of your passwords and login credentials and your Account. We recommend that you change your passwords regularly.

    When you register to the Panel, your Account will have the status Registered. It means that you can participate in the Activities you are invited to by Worldpanel by Numerator, and you can enjoy the Panel benefits of accessing our Services and contacting our Personnel. Shop & Scan Points will be awarded to your Account when you undertake Activities during this registration period.

    30 days after registration, your Account will have the status Active and you will be able to redeem Points for rewards.

    Under certain circumstances, including those described herein, your Account may be closed or suspended by Worldpanel by Numerator, at which point you will no longer be considered in good standing and will be unable to participate in future Activities and Panel benefits.

    7.1 Closure of your Account

    Your Account can be closed at any time and for any reason, in Worldpanel by Numerator’s sole discretion, including if you breach these Terms. Without limiting the foregoing, Worldpanel by Numerator also specifically reserves its right to terminate your Account if Worldpanel by Numerator’s right to process and use information which is necessary to run the Panel is legally withdrawn, by law or otherwise. Worldpanel by Numerator may also terminate your membership immediately without specifying a reason.

    The closure of your Account means that your access to and use of the Services will be disabled. All Points, incentives and rewards shall be subject to redemption or forfeiture at Worldpanel by Numerator’s discretion. Once your Account is closed, we cannot reinstate it.

    7.2 Suspension of your Account

    Your Account can be suspended leading to closure at any time and at Worldpanel by Numerator’s discretion if one of the following situations arise:

    No participation after you’ve joined the Panel If you register to the Panel and do not submit a valid shopping trip within your first 28 days after joining the Panel.
    No participation in the last 50 days If you do not participate in the panel for a period of 50 consecutive days.
    Account security If our systems detect an anomaly with your Account or if we believe that your Account has been compromised.
    Quality If your participation doesn’t meet the quality criteria specified above in Section 5.7 "Quality checks".
    7.3 Your right of second review

    If your Account has been suspended or closed, you have the right to ask Worldpanel by Numerator to investigate the situation and to confirm or reverse the decision which impacts the standing of your Account. To ask Worldpanel by Numerator for a second review, you need to go to the Shop & Scan website and contact the Panel support team, by completing the contact form. You may be requested to prove your identity. Worldpanel by Numerator will respond to your petition within 30 days. We will then communicate with you the conclusion of this investigation and our final decision. By agreeing to these Terms, you agree that Worldpanel by Numerator’s decision is final and that the level of detail shared with you through this right to appeal will be solely determined by Worldpanel by Numerator.

    7.4 Your right to close your Account (unsubscribe)

    If you wish to unsubscribe from the Panel and close your Account, you can close your Account by contacting our Panel support team. Your Account will be closed, and the Panel support team can support with the redemption of any Points or vouchers due. Your personal data will be deleted in line with our Privacy Policy.

  8. Confidentiality & Copyright

    The Services and other materials contained on the Site or within the Services and Activities provided to you by Worldpanel by Numerator, including, without limitation, the Worldpanel by Numerator, Kantar and Shop & Scan marks, logos, and all information, content, designs, text, graphics, information, data, software, other files, and the selection and arrangement thereof (collectively, the "Content"), are the property of Worldpanel by Numerator, its Vendors, licensors and clients and are protected by U.K. and international copyright laws.

    As long as you comply with these Terms, Worldpanel by Numerator grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the Services, solely for your personal, non-commercial purposes in accordance with these Terms. Except for those rights expressly granted in these Terms, no other rights are granted, either express or implied, to you under these Terms. Unless explicitly stated in these Terms, nothing in these Terms will be construed as conferring to you any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time.

    Any use of the Services or any Content other than as specifically authorized in this Agreement and by applicable laws and regulations, without the prior written permission of Worldpanel by Numerator, is strictly prohibited and will terminate the license granted in this section. Your Account will be closed immediately without any notification.

    For clarity, by agreeing to these Terms, you explicitly agree to refrain posting any Content on the Internet, regardless the type of sites, including but not limited to social sites such as Facebook, X, YouTube. You also refrain taking pictures of Content using a smartphone, a camera or any similar devices. You agree to keep any Content shared with you as confidential at all times, including not discussing Activities with your friends and acquaintances. You hereby acknowledge that any violation of the confidentiality obligations imposed under these Terms would cause irreparable harm to Worldpanel by Numerator and/or its Vendors, and that remedies at law would be inadequate to redress any actual or threatened violation of these Terms. Accordingly, you agree that, in addition to other any other relief available, Worldpanel by Numerator and/or its Vendors may seek to enforce the confidentiality obligations by temporary and permanent injunctive relief, without posting a bond or proving actual damages.

  9. Trademarks

    Kantar, Shop & Scan and Worldpanel by Numerator marks and logos, and other products, service names or slogans contained in any Content or otherwise within the Services are property of Worldpanel by Numerator, its Vendors or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Worldpanel by Numerator or the applicable right holder. All other trademarks, registered trademarks, product names and company names or logos appearing in the Services or in any Content are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by Worldpanel by Numerator. All rights are reserved.

  10. Disclaimer of Warranties

    Your use of the services, including, without limitation, your use of any content, is at your sole risk. The services and all content are provided on an "as is" and "as available" with all faults basis. Worldpanel by Numerator, its vendors, licensors, and suppliers, and their respective members, directors, officers, agents, and employees (collectively, the "Providers") expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

    Neither Worldpanel by Numerator nor any other providers warrant uninterrupted use, operation, or availability of the services or any content, or that any submission or transaction request you attempt using the services will be successful, uncorrupted, or completed within a reasonable amount of time. You will be solely responsible for any delay or loss of any kind that results from your access to, or use of, the services and the content. No advice or information, whether oral or written, obtained by you from Worldpanel by Numerator or any other provider through or from the services, will create any warranty regarding the services that is not expressly stated in this agreement. Some jurisdictions may prohibit a disclaimer of warranties and you may have other rights that vary from jurisdiction to jurisdiction.

    User-Generated Content, in particular, is provided by and is solely the responsibility of the users providing that Content. No advice or information, whether oral or written, obtained from other users or through the Services, will create any warranty not expressly made herein.

    Services may contain links or references to information, content, and services provided by third parties (collectively, "Third-Party Content"). Worldpanel by Numerator does not monitor or have any control over Third-Party Content. Worldpanel by Numerator does not endorse or adopt any Third-Party Content and can make no guarantee as to its accuracy or completeness. Worldpanel by Numerator undertakes no responsibility to update or review any Third-Party Content, and does not represent or warrant the accuracy of any information contained in any Third Party Content. You use any Third-Party Content contained therein at your own risk. Views expressed in Third Party Content are not endorsed by Worldpanel by Numerator.

  11. Limitation of Liability

    To the maximum extent permitted by law (including, without limitation, negligence), under no circumstances will Worldpanel by Numerator or any other providers will be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including, without limitation, damages for loss of profits, revenue, goodwill, use, data, or other intangible losses (even if Worldpanel by Numerator or any other providers have been advised of the possibility of these damages), resulting from your access to or use of, or your inability to access or use, the services or any content. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

    To the maximum extent permitted by law, the maximum total liability of Worldpanel by Numerator and all other providers to you for all claims under this agreement, whether in contract, tort, or otherwise, is the greater of (a) any amounts paid by Worldpanel by Numerator to you under this agreement in the twelve months preceding the applicable claim, and (b) 100 Pounds Sterling (£100 GBP). Each provision of this agreement that provides for a limitation of liability, disclaimer of warranties, releases or exclusion of damages is to allocate the risks under this agreement between the parties, and reflects a fair and reasonable allocation of the risk between you and Worldpanel by Numerator. Worldpanel by Numerator would not be able to provide the services and content to you on an economically reasonable basis without these limitations, disclaimers and releases, and this allocation is an essential element of the basis of the bargain between the parties. Each of these provisions is severable and independent of all other provisions of this agreement. The limitations in this section will apply even if any limited remedy fails of its essential purpose.

  12. Indemnification

    To the maximum extent permitted by applicable law, you will indemnify and hold harmless Worldpanel by Numerator and all other Providers from and against any costs, damages, expenses, and liabilities (including, but not limited to, reasonable attorneys' fees) arising out of or related to any User Content, your use of the Services or any Content, your violation of this Agreement, or your violation of any rights of a third party. Worldpanel by Numerator reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify Worldpanel by Numerator under this Agreement, and you agree to cooperate with our defence of such claims.

  13. Privacy & Data Protection

    Worldpanel by Numerator may collect registration data and obtain other information about you through the Services. Please see our Privacy Policy for information regarding Worldpanel by Numerator's collection, use, and disclosure of such information. Worldpanel by Numerator will never rent or sell your personal data without your permission.

  14. Independent Contractors

    You and Worldpanel by Numerator are independent contractors for all purposes. No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement or by your access to or use of the Services.

  15. Termination

    Notwithstanding any term of this Agreement, Worldpanel by Numerator reserves the right, without notice and in its sole discretion (except where otherwise restricted by law), to discontinue or terminate any of the Services, to terminate your license to use the Services, to delete any Accounts, Panel registrations or other accounts, to delete Points without redemption, and to restrict, block, limit, and prevent your access to and use of the Services. Any termination or other action by Worldpanel by Numerator described in this paragraph will not limit any other remedies available to Worldpanel by Numerator at law, equity or otherwise.

  16. Updates and changes to this Agreement

    We reserve the right to change, modify, add or remove portions of the Terms at any time, at our sole discretion. When we update these Terms, we will revise the "updated" date. If the changes are material, we will email you or may ask you to agree to such material changes. You are responsible for reviewing and adhering to the most recent update of these Terms. Your continued use of our Site and Services will always indicate your acceptance of the latest version of these Terms.

  17. Change of panel ownership

    If it happens that Worldpanel by Numerator merges with another company or is purchased by another company or that the Panel is merged with another panel, you grant Worldpanel by Numerator permission to take the necessary steps to manage your Account through this situation. Worldpanel by Numerator will take all reasonably necessary steps to protect your personal data and Account-related data, e.g. your Points or your rewards.

  18. General Legal Notices

    By accessing or using the Services, you consent to receiving electronic communications from Worldpanel by Numerator. These communications may include notices about your Account and information concerning or related to the Services. You agree that any notices, agreements, disclosures, or other communications that Worldpanel by Numerator sends to you electronically will satisfy any legal communication requirements, including any requirement that communications be in writing.

    Worldpanel by Numerator's failure to act in a particular circumstance does not waive its ability to act with respect to that circumstance or similar circumstances.

    Any provision of this Agreement that is found to be invalid, unlawful, or unenforceable will be severed from this Agreement, and the remaining provisions of this Agreement will continue to be in full force and effect. The section headings and titles in this Agreement are for convenience only and have no legal or contractual effect. Any provisions in this Agreement that by their nature should survive the termination of this Agreement (including, without limitation, provisions governing indemnification, limitations on liability, disclaimers of warranty, and ownership of intellectual property) will continue to remain in full force and effect after the termination of this Agreement.

    This Agreement, your use of the Site and Worldpanel by Numerator’s provision of Services is governed by the laws of England and Wales, excluding conflicts of law principles. Any controversy or claim arising out of or relating to the Services or this Agreement must be commenced within one year after the claim arose. Before commencing a claim, you must have satisfied the conditions precedent in this Agreement, including but not limited to, following the requirements for a second review as described in Section 7. The parties hereto further agree that they shall bring any action or proceeding arising from or relating to the Services or this Agreement exclusively in the courts of England and Wales.

    EACH PARTY HERETO IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT.

    This Agreement, including all terms, policies, and guidelines referenced in this Agreement, is the entire agreement between you and Worldpanel by Numerator concerning the Services. This Agreement supersedes all prior agreements or communications between you and Worldpanel by Numerator regarding the subject matter of this Agreement.

Shop & Scan Rewards Program Terms

  1. These Shop & Scan Rewards Program Terms ("Rules") apply to all promotions run by Worldpanel by Numerator, including, but not limited to, the Points Program, as promoted on the Shop & Scan panel Site ("Site"). Shop & Scan ("Shop & Scan") is the name of the panel operated by Worldpanel by Numerator.
Accumulation of Shop & Scan points
  1. Once you have joined Shop & Scan, you will be offered incentives in the form of points ("Points") or other Shop & Scan types of incentives will be awarded when you undertake various Activities on the Site.
  2. When you register with Shop & Scan, your Account will have the status "Registered". You will be able to participate in all Activities you are invited to by Worldpanel by Numerator, and you can enjoy all Shop & Scan benefits, such as accessing our Services and contacting our Personnel. 30 days after registration, your Account will have the status "Active", and you will be able to redeem Points for rewards. To keep your Account Active, you must regularly submit a valid shopping trip or Nothing Bought declaration.
  3. Points will automatically be awarded for the completion of Activities as described on the Site. You may also be invited to complete surveys which will award additional Points. Where a survey does not carry Points, this will be clearly stated on the Site at the beginning of the survey or in the survey invitation email that you will receive from us.
  4. Your Account can be suspended if one of the following situations arises:

    • No participation after you have joined Shop & Scan;
    • Not submitting a valid shopping trip within your first 28 days from joining Shop & Scan; or
    • No participation in the last 50 days.

    If your Account has been suspended or closed, you have the right to ask Worldpanel by Numerator to investigate the situation. You should go to the Shop & Scan website and contact the Panel support team by completing the contact form. Upon receipt of your notice, we will investigate your claim and notify you of our decision within thirty (30) days. Any decision by Worldpanel by Numerator with regard to such a claim will be final.

  5. Worldpanel by Numerator may also terminate your membership immediately without specifying a reason. All Points, incentives and rewards shall be subject to redemption or forfeiture at Worldpanel by Numerator’s discretion. If not subject to forfeiture, Points must be redeemed within 30 days of Account closure (or within 8 weeks of Account closure if you transmit barcodes via a scanning device provided in the post by Worldpanel by Numerator). Once your Account is closed, we cannot reinstate it.
  6. If you wish to unsubscribe from the Panel and close your Account, you can close your Account by contacting our Panel support team. Your Account will be closed, and the Panel support team can support with the redemption of any Points or vouchers due. All Points must be redeemed within 30 days of Account closure (or within 8 weeks of Account closure if you transmit barcodes via a scanning device provided in the post by Worldpanel by Numerator), at which point the Account balance will be set to zero and no further redemptions will be possible.
  7. Points awarded for panel Activities will be posted to your Account weekly, and in any event, no later than 30 days following Activity completion. Points will be available for redemption as soon as they are posted to your Account and as long as your Account is Active. Points cannot be redeemed within the first 30 days of Shop & Scan membership. Worldpanel by Numerator takes reasonable care to ensure Points are accurately deposited in your Account. However, you are responsible for ensuring that your Points are correctly deposited and you should notify Worldpanel by Numerator within 2 months of completion of an Activity if Shop & Scan Points have not been correctly posted to your Account.
Shop & Scan points values
  1. You will receive a certain number of Shop & Scan Points per completed Activity. The number of Shop & Scan Points available for any Activity will be stated on the Site.
  2. You can view your total number of Shop & Scan Points online by logging into the Site. Rewards account queries can be directed to the rewards helpline on 08003 890 342 or emailed to rewards@shopandscan.co.uk
  3. Shop & Scan Points are personal to you. They are not considered to be property, and as such, you cannot sell, transfer or assign your Points to any other person without Worldpanel by Numerator's written permission.
Redemption of Shop & Scan points

  1. You can only redeem your Points if you have enough points to allocate against the lowest reward value on the Site and if your Account is in good standing.
  2. All Shop & Scan Points must be redeemed online via the Site or by calling the rewards helpline. Other Shop & Scan redemption methods may be added or substituted in the future at Worldpanel by Numerator's sole discretion.
  3. The value of 1,000 Shop & Scan Points is currently £1. Worldpanel by Numerator reserves the right to change this value without notice, and any change will be set out on the Site or within these Rules.
  4. Shop & Scan Points can currently be redeemed for gift vouchers. The minimum voucher redemption value is £10, equivalent to 10,000 Shop & Scan Points.
  5. Details of the vouchers available for redemption can be found on the Site. Worldpanel by Numerator reserves the right to change the gift vouchers offered on the Site at its discretion and without notice. You acknowledge that Worldpanel by Numerator is not responsible for any actions taken by our Rewards partners in connection with the redemption of Shop & Scan Points.
  6. The value of your selected reward may not exceed the number of Shop & Scan Points in your Account. However, you may select a reward of lesser value. Any unused Shop & Scan Points will remain in your Account for future use and once you redeem Shop & Scan Points, the appropriate number of Points will be deducted from your Account.
  7. Shop & Scan Points are non-negotiable and may only be redeemed for the rewards stated above, or on the Site.
  8. Reward vouchers received as a result of redemption of Shop & Scan Points cannot be exchanged, returned or redeemed for cash value. You are responsible for checking the expiry date applicable to any voucher received and using the voucher before this expiry date. You acknowledge that Worldpanel by Numerator is not responsible for replacing expired reward vouchers.
  9. The rewards pictured on the Site may not necessarily reflect the exact colours or models of actual rewards, due to printing variations and manufacturers' updates.
  10. Worldpanel by Numerator reserves the right to substitute any reward for a reward of equivalent or higher value if a reward is not available.
Administration of rewards
  1. Worldpanel by Numerator reserves the right to appoint a third party to administer its Points Program and rewards. You should read the Privacy Policy regarding information that will be passed to third parties in order to administer the Points Program and rewards.
  2. Worldpanel by Numerator does not accept any liability for any losses suffered by you due to any error or omission by the third party in the administration or delivery of rewards.
  3. Voucher orders will be processed and despatched within 5 working days in the majority of cases. At times of high demand, despatch times may be longer.
  4. E-vouchers will only be despatched to the email address registered to the Shop & Scan Account.
  5. Paper vouchers will only be despatched to the home postal address registered to the Shop & Scan Account. Order values up to £80 will be sent via Royal Mail 1st Class delivery. Order values over £80 will be sent via Royal Mail Recorded or Special Delivery and may require a signature when delivered.
  6. Apple is not involved in any way with the contest or sweepstakes run by Worldpanel by Numerator.
